Dad Is Told His Long-Awaited Daughter Died At Birth – He Gets a Message 'I Got The Baby' 3 Weeks Later

Brandon Marteliz, a father from Hillsborough County, was excited to welcome his child but found himself standing in an empty kids' bedroom. He and the mother of his child had been in contact a day before she was meant to give birth.

He texted to ask if she would be at the hospital the next day, and the woman said she believed she would. The father-to-be followed up by asking if she would come outside, but he never got a response.
Marteliz was then told that his baby had died. According to legal documents, the mother stated the child passed due to sudden infant death syndrome (SIDS).

However, Marteliz struggled to accept the death. He went to hospitals, trying to find out more about his daughter, but he was kicked out by security. Three weeks later, he was shocked to get a text from his daughter's mother that said, "I have her. I got the baby." But Marteliz did not know that this would be the start of a long battle.
Marteliz texted back, saying, "I wanna see my baby." He discovered that there was a baby that was born and given up for adoption, which turned out to be his daughter. The father thought it would be as easy as proving to the adoption agency that he was the child's biological father, but it was not.

This left the Hillsborough County father fighting for custody while his daughter lived with her potential adoptive parents. The legal documents also show that the mother consented to the adoption and listed Marteliz as a "man who may have interest in the minor child."
In May 2021, Marteliz admitted that he did not know that the child's mother had wanted to give the child up for adoption. He also denied not giving her any financial assistance during her pregnancy.

However, he stated that he was not in communication with the child because the mother and the adoptive parents did not allow him. Things became even more complicated for him because the adoption agency did not need to terminate his parental rights since he and his mother were not married.
He was also not listed on the child's birth certificate, making it difficult to claim his paternity rights. Marteliz said the adoption agency tried to explain that his daughter would be put into a loving home, but he did not want to back down.
The worried father was willing to do anything to be reunited with his daughter. He filed a petition to determine paternity, "I am willing to pay whatever form or support or cost it takes." proclaimed Marteliz. Marteliz lost his custody in court, and reports state that his window to appeal has closed. But despite hitting these walls, he is not willing to give up.
Marteliz now finds himself standing in his daughter's empty bedroom, wondering if he will ever see her in it. As the months pass, the father is considering giving some of the stuff away. While he understood that some people struggled to have children, he argued that things were different because he could care for his child.
However, he has not lost hope. He shared a heartfelt message on Facebook stating how much he wanted his daughter to know he fought for her. "One day we will read this together, and you will know how much your father loves you And what I will donor go thru for u, baby," expressed Marteliz.
David Hurvitz, Marteliz's attorney, predicted this would be a long battle because they are fighting a law in favor of adoption agencies. One parent reportedly found themselves fighting for their child's custody five years after they were born.
