Police Officer Filmed Telling Black Man He Doesn't 'Have the Right to Remain Silent'
Footage of a white police officer telling a black man that he doesn’t “have the right to remain silent” sparked debate on TikTok over the Miranda rights.
Police officers must recite the Miranda rights when arresting a person, with some situations exempted, for the criminal or violator to be aware of his rights.
However, one police officer refused to give a man his right to remain silent after pulling him over on the roadside. Footage of the cop has since been posted on TikTok and immediately went viral with nearly 1 million views.

In the clip, posted by TikTok user @jaythesaint9, a black man dressed in black pants, a winter jacket, and shades talked to two white police officers who cornered him.
Although most of the video was inaudible, it was clear that the man said, “I’m not answering any questions,” as part of his 5th Amendment right. However, one cop replied:
“You don’t have the right to remain silent.”

Although not much context was provided in the clip, it was clear that the Washington, D.C. police officer disregarded the man’s Miranda rights.
Another video of white cops cornering a black woman went viral as she claimed that she was being harassed at that moment.
The post immediately sparked debate among TikTok users, who expressed their thoughts in the comments section about the Miranda rights and the man’s situation.
According to one user, “Your Miranda right to remain silent doesn’t kick in until you are arrested. But no law says you have to talk to them at all.”
However, other users claimed that the right could be invoked at any time once a police officer is involved. Furthermore, the man could demand a lawyer immediately. Another comment read:
“Yeah, no the 5th [amendment] rights don’t have an on switch, they just exist… at all times.”

Recently, another video of white cops cornering a black woman went viral as she claimed that she was being harassed at that moment.
In the footage, the woman sat in a park and quietly studied her book as two officers approached her to inform her that she could not enter the park next week without a child.
Despite telling the authorities that she did not plan to go to the park, they kept explaining and repeating that the woman couldn’t enter.
